The State Board of Education met on Wednesday in a called meeting and according to a release, SBE Chairman Bill Cobey has authorized the State Board of Education’s attorney to file a constitutional challenge to NC Session Law 2016-126.

“The State Board of Education today (Wednesday) authorized its attorneys to move forward with a constitutional challenge to the provisions of NC Session Law 2016-126 that attempt to transfer the State Board of Education’s constitutional powers and duties to the State Superintendent of Public Instruction,” said Chairman Cobey in a release from the State Board of Elections.

The new law basically strips the State Board of Education of its constitutional powers and instead gives that authority to newly-elected State Superintendent of Public instruction Mark Johnson. 

The bill, which is scheduled to take effect on January 1, calls for the transfer of the decision-making power over the state’s schools away from the State Board of Education and gives it to newly elected State Superintendent Mark Johnson, who is a Republican. The new law gives the State Superintendent more authority over certain functions such as budgetary matters, personnel matters and issues related to school performance to name a few things.
